These Terms of Use govern your use of EarBird: Bird Song Quiz (“the app”), a bird-song quiz for learning to recognise birds by ear, published by Peidus Products OÜ. By downloading or using the app, you agree to these terms.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, subject to these terms and the rules of the app store you downloaded it from.

Purchases

The app offers an optional premium upgrade. Purchases are billed through your Apple App Store or Google Play account. Where a subscription is offered, it renews automatically unless cancelled at least 24 hours before the end of the current period; where a free trial is offered, unused trial time is forfeited if you purchase. You can manage or cancel subscriptions in your App Store or Google Play account settings. Prices are shown in the app before purchase and may vary by region.

Third-party content

The bird audio recordings in the app are sourced from xeno-canto and the bird photographs from Wikimedia Commons. This content remains the work of its original authors and is used under Creative Commons licences (CC0, CC BY, or CC BY-SA); per-item attributions and licence details are listed in the app. Your licence to the app does not grant you any rights to extract or redistribute this content beyond what its Creative Commons licence allows.

Acceptable use

You agree not to reverse-engineer, tamper with, or attempt to circumvent the intended operation of the app, and not to use it in any way that breaks the law or infringes the rights of others.

Availability

We may update, change, or discontinue features of the app at any time. The core experience is designed to work offline without an account. Some features (such as purchases) rely on third-party services and your network connection, and may be unavailable from time to time.

No warranty

The app is provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law. The app is a learning game — it is not a scientific identification tool, and species information may contain errors.

Limitation of liability

To the maximum extent permitted by law, Peidus Products OÜ will not be liable for any indirect, incidental, or consequential damages arising from your use of the app. Nothing in these terms limits liability that cannot be limited under applicable law.

Governing law

These terms are governed by the laws of Estonia, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live.
